How to Get Out of a Loan Guarantee, and What to Check Before You Sign
Summary
There are only four realistic ways out of a loan guarantee: the borrower settles the loan in full, the lender agrees to release you or to accept a substitute, the loan is refinanced into someone else's name, or your guarantee is a continuing one you can still revoke for future drawdowns. Nothing you arrange privately with the borrower releases you, which is why the checks that matter most are the ones you make before signing.
You can get out of a loan guarantee in four realistic ways: the borrower settles the loan in full, the lender agrees to release you or to accept a substitute guarantor, the loan is refinanced into someone else's name, or your guarantee is a continuing one that you can still revoke for future drawdowns. Everything already drawn stays with you until the lender releases you in writing, which is why the checks that really matter happen before the pen moves.
Can you simply withdraw a guarantee you have given?
It depends on which kind you signed, and most people do not know which they signed. A specific guarantee covers one named facility of a stated amount, and there is nothing to revoke: the exposure was created the day the money was released. A continuing guarantee, often worded to cover all monies now or later owing, covers a series of transactions, and under the Contracts Act 1950 it may be revoked as to future transactions by notice to the lender.
So revocation is a question of timing: notice stops the exposure growing, but does not undo what is already drawn. Send it in writing and keep proof of delivery.
What are the routes out of a guarantee that is already live?
- Full settlement by the borrower. The clean exit. Ask for a settlement figure, and once it is paid, ask for a written discharge letter naming you. Then check your own credit record.
- Substitution. The lender releases you and accepts another guarantor, or additional security, in your place. Discretionary, but it is the route that most often works on a loan being paid on time.
- Refinancing. The borrower takes a new loan in their own name, or with a different guarantor, and clears the guaranteed one. Compare the total cost first: a longer tenure can cost more even at a lower rate.
- Restructuring with your release as a condition. If the borrower's income has improved, ask in writing for the facility to be rewritten without a guarantor.
- Discharge by operation of law. A guarantee can be affected where the lender varies the loan terms without the surety's consent, releases the borrower, or compounds with the borrower. The Contracts Act 1950 covers these situations, but an all-monies guarantee may have consented to variations in advance, so ask a lawyer rather than assume it.
Notice what is missing: anything you can do on your own. Every workable route needs either the borrower's money or the lender's signature.
What should you check before you sign a guarantee?
- Which role are you signing? Read the signature block. Guarantor, surety and joint borrower are three different commitments, and the wrong box gets signed often.
- Is there a cap? A stated maximum figure is the most valuable clause you can ask for. No figure means the whole debt plus interest, charges and costs.
- Specific or continuing? Does it cover this facility only, or everything the borrower may owe later, including top-ups and new loans?
- What triggers a demand on you, and must the lender pursue the borrower first?
- Do you get information? Ask for a written right to statements and to notice of any missed payment. Without it, you will learn about arrears from a letter of demand.
- Does it survive a restructuring you were not consulted about, or an assignment of the facility?
- Is there a rebate on early settlement, and what is the formula? It decides the size of any future demand.
- What does it do to your own borrowing? An instalment of RM675 against a net income of RM4,000 is almost 17 per cent of it, before your own commitments. And could you pay the whole balance if asked? If the answer is no, the honest decision is no.
Check who the lender is as well. A bank is supervised by Bank Negara Malaysia, while a non-bank money lender is licensed under the Moneylenders Act 1951 through the ministry responsible for housing and local government, which publishes the rules at the official ministry site, kpkt.gov.my.
The independent, unofficial (Laju Dana) Loan App SIM listing on this site describes a loan simulation app, calculator and guide that works only on figures you type in. It is not a lender and cannot release anyone from anything.
What does not get you out of it?
- A private agreement with the borrower. A promise that they will never let it fall on you is worth nothing to the lender.
- A change in the relationship. Divorce, a family rift, resigning or moving abroad do not touch a guarantee.
- Time passing. A guarantee does not expire because the loan has behaved well for three years.
- Death. For a continuing guarantee, death may end cover for future transactions, but an estate can remain answerable for what was already drawn.
What should never be part of a guarantee?
A guarantee is a signature at the lender's own counter, or before an authorised attestor. A request for any of the following means you are not dealing with a lender:
- Your identity card, your ATM card and PIN, or your online banking login. None of these is security that anyone may hold.
- A one-time PIN read out over the phone or typed into a link sent to you.
- A payment from you before the loan is released, whether it is called processing, stamping, insurance or clearance.
- Letting money pass through your bank account for someone else, or signing a blank page you are not given a copy of.
Frequently asked questions
Can I cancel a guarantee if the loan has already been paid out?
Not on your own. Revocation works on future transactions under a continuing guarantee; a sum already drawn stays covered until it is settled or released in writing.
Will the lender release me if the borrower has paid on time for years?
Sometimes, and it costs nothing to ask in writing. There is no automatic release on a personal loan, so a good payment record is an argument, not an entitlement.
Does the borrower refinancing elsewhere release me automatically?
Only once the guaranteed facility is actually settled and closed. Get the discharge letter, and do not rely on being told that the loan has moved.
Ask for a cap, ask for statements, ask what would release you, and get the answers on paper. Guaranteeing a relative's loan can be a genuinely good thing to do, but it should be a decision you could afford to be wrong about.
